Terms of Service

KAV Labs, LLC ("KAV Labs," "we," "us," or "our") provides pre-built connectors and integrations for Klaviyo and related services through the website www.kavlabs.co (the "Service").

These Terms of Service ("Terms") govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that any information you provide is accurate and current.

2. Accounts

If the Service requires an account, you are responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

We reserve the right to suspend or restrict access to the Service for any user who violates these Terms.

4. Third-Party Services

The Service integrates with and relies on third-party platforms, including Klaviyo and other services you connect. Your use of those platforms is governed by their own terms and policies. We are not responsible for the availability, accuracy, or practices of any third-party service, and we are not liable for any loss arising from your use of them.

5. Fees and Payment

Certain features of the Service may require payment. Fees, billing cycles, and any applicable taxes will be described at the time of purchase. Payments are processed by our third-party payment processor, Stripe, and by purchasing you agree to Stripe's applicable terms. Unless otherwise stated, fees are non-refundable. We may change our pricing at any time, with changes taking effect for subsequent billing periods.

6. Intellectual Property

The Service, including all software, connectors, content, trademarks, and related materials, is owned by KAV Labs or its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your information. By using the Service, you consent to those practices.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, KAV Labs and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless KAV Labs and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted here with a revised "Updated" date. Significant changes may also be communicated by email or a notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Delaware.
